To be informed about all the terms of use of this website, please go through all the following sections. Jadrel Software and IT Services SRL reserves the right to make changes and updates to these terms and conditions, as well as to the offer, without prior notice and without specifying the reason, as well as the right to correct any omissions or errors in display that may occur due to typing errors, lack of accuracy or errors of software products, without prior notice. PRIVACY POLICY TERMS AND CONDITIONS OF USE & PERSONAL DATA PROCESSING (hereinafter referred to as "the Policy ") The purpose of this Policy is to explain the type of personal data collected, how it is processed, the rights of data subjects, their retention time as well as other information related to the processing of personal data. Data protection is a priority for the management of Jadrel Software and IT Services SRL headquartered in Bucharest, Zboina Neagra Street, no. 8-10, Building      91-95, Entrance 3, 2nd Floor, Ap.99, Sector 6, telephone number: 0756690714,                             e-mail: office@jadrel.ro, registered at the Trade Registry Office with no. J40 /14034/2021, having the fiscal identification code RO44742222, registered and endorsed by ANSPDCP (National Authority for the Supervision of Personal Data Processing) with no. registration number 10261, hereinafter referred to as Jadrel. Browsing the pages of our website is possible without declaring any personal data. However, for certain specific situations such as completing a survey or participating in a contest, certain personal information belonging to data subjects might be collected and processed . If the processing of personal data is necessary and there is no statutory basis for this processing, we undertake to obtain the consent of the data subject. The processing of personal data - such as name, surname, address, e-mail address, phone number - will be carried out, each time, in accordance with the stipulations of Regulation no. 679 of 27 April 2016 regarding the protection of individuals, related to the processing of personal data and the free movement of such data, as well as with the repealing of Directive 95/46/CE (the “Regulation”), and also in accordance with specific data protection regulations of the country in which Jadrel operates.
Through this Policy, our company would like to inform the general public about the nature, the extent and purpose for which we collect and process personal data. In addition, the data subjects are also informed about the rights they benefit of, rights stipulated by the Regulation. As an operator, Jadrel has implemented numerous technical and organizational measures to ensure the complete protection of personal data. Any data subject can contact us directly at any time with any questions or suggestions regarding the protection of personal data at the following e-mail address: office@jadrel.ro . PRODUCT AVAILABILITY In stock = the product is in Jadrel’s stock, in the central warehouse, and is available for delivery/pick-up in the terms mentioned in the shopping cart page/e-mail order confirmation/SMS. In supplier’s stock = The product is not available in Jadrel’s stock and is ordered from the supplier immediately after the completion of your order. The estimated delivery time is the one displayed on the product page. In the event that the supplier cannot fulfill the order, a Jadrel consultant will contact you to cancel/change the order with a similar product or to communicate a rectified delivery time. Unavailable = The product is not available in Jadrel’s stock and, at the moment, we do not have information about its availability in the supplier's stock. We recommend that you sign up for the Notify Me alert and you will be automatically notified when the product is back in stock. Pre-order = The product is not currently available and will be in stock at the estimated time displayed on the product page on Jadrel’s website. The actual delivery time may change, depending on availability at the manufacturer / supplier. Promotions on Jadrel’s website are applied according to our available and limited stock. REVIEWS/ QUESTIONS AND ANSWERS Review - a written evaluation by a customer of a good or service, presented on https://www.jadrel.ro/ website. Rating - a way of expressing the degree of satisfaction of a customer with a product or service. The grade is expressed in the form of stars and each good or service can receive a score from one star to five stars. Merchant Response - The response provided by Jadrel’s technical staff to a review received from a customer. Fourteen days after the purchase of a product or service, the customer will be asked to write a review of the purchased good or service. The request will be sent to the e-mail address of the customer’s account. WRITING REVIEWS / QUESTIONS Writing reviews can be done by customers in the "Reviews / Questions and Answers" sections. The information submitted can be both positive and negative, and will relate to the characteristics and use of a product or service. Each customer, at the time of writing a review in the mentioned section, agrees to abide by the following rules: to refer only to the characteristics and/or the way of using a certain product or service,         avoiding information related to aspects that may change in time (i.e. price or promotional offers) or information related to order conduct; to use appropriate, non-offensive language, without using terms that may offend or affect any other customer; to ensure that the information entered is realistic, correct, not misleading, and in accordance with applicable law, including respect for the rights of other parties, copyright, trademark, license or other property, advertising or privacy rights; to not provide or request, in any way, personal data (contact details, information about delivery or home address, telephone numbers, e-mail addresses, name and/or surname, etc.) or any other information that may lead to the disclosure of such personal data; not to use the reviews section as a means of communication with the seller; for this purpose, the contact details of the seller registered on the site will be used. In addition to a realistic and critical evaluation, when submitting a review, the customer will also add a relevant grade for the related product or service. Reviews, along with their respective ratings, will influence the overall rating of the product or service, a number that appears next to their name. Customers who submit reviews that include photo files will act in accordance with the following rules: uploaded files will contain images that relate to the product or service for which the review is being written, ensuring that uploaded files comply with copyright; uploaded files will not contain violence, adult content, foul language, or other content that offends a person/ group using race or ethnicity, religion, disability, sex, age, veteran status, sexual orientation or political; uploaded files will not contain information about other people; uploaded files will not contain URLs or watermarks to sites that carry out the same business as the seller. When a review is reported by a customer as having inappropriate content, from a strictly and subjective perspective, this content is carefully examined by Jadrel to determine if it violates the website’s Terms and Conditions. The texts, photos or videos submitted are removed from the website only after being examinated by Jadrel. If Jadrel finds a repeated violation of the Terms and Conditions, he reserves the right to suspend the customer's ability to submit reviews. For reports or complaints related to a purchased product and/ r service, the customers can fill out a complaint form on the website: DEFINITIONS This Policy is based on the Regulation as well as any and all applicable laws regarding the protection of personal data. The policy must be comprehensible both to the general public as well as to our clients and business partners. To ensure this, we will explain the terminology used.        In this Policy we will use, inter alia, the following terms:

  • Personal Data - refers to any information that makes it possible to identify an individual (data subject);
  • Target person - represents an identified or identifiable individual. An "identifiable" individual is a person who can be identified, directly or indirectly, by reference to an identification number or to one or more features characteristic of his or her physical, physiological, mental, economic, cultural or social identity;
  • Processing - means performing any operation or set of operations on personal data, with or without automatic means, such as gathering, registering, organizing, storing, adapting or modifying, retrieving, consulting, using, disclosing (by transmitting, broadcasting or making available in a different way), aligning or combining, blocking, deleting or destroying;
  • Restriction of processing - refers to the marking of processed personal data in order to limit their processing in the future;
  • Profiling - refers to any authorized form of personal data processing consisting of the use of personal data to assess certain personal aspects of an individual, in particular to analyze or predict aspects related to work performance, economic situation, health, personal preferences, interests, reliability, location or movements of an individual;
  • Pseudonymization - is the processing of personal data in such a manner that the data can no longer be attributed to a data subject without the use of additional information, provided that this additional information is stored separately and is subjected to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable individual;
  • Operator or operator responsible for processing - is an individual or legal person, public authority, agency or any other official who, alone or with the help of third parties, determines the purposes or means of processing personal data; where the purposes and means of processing are determined by Union’s or Member States’ legislation, the operator or the specific criteria for his nomination may be provided by the Union’s or the Member States’ legislation;
  • Recipient - is an individual or legal person, public authority, agency or other body, to whom personal data is disclosed, whether he represents a third party or not. However, public authorities who may receive personal data in a particular investigation in accordance with Union’s or Member States’ legislation will not be considered recipients; the processing of such data by public authorities shall be made in compliance with the rules applicable to data protection in accordance with the purposes of the processing;
  • Third party - is an individual or legal person, public authority, agency or other official other than the data subject, operator, processor and persons who, under the direct authority of the operator or processor, are authorized to process personal data;
  • Consent - the consent of the data subject is any indication given freely, specifically, clearly that the data subject provides through a statement or a clear affirmative action, signifying the agreement for the processing of his personal data.

  COOKIES Jadrel’s website uses cookies. Cookies are text files that are stored on a computer via an internet browser and, nowadays, many sites and servers use cookies. A cookie ID is a unique identifier of a cookie, which consists of a string through which web pages and servers can be assigned to the web browser in which the cookie was stored. This allows the websites and servers visited to differentiate the individual data browser from other internet browsers that contain other cookies. By using cookies, Jadrel may provide website users with several easy-to-use services that would not be possible without setting cookies. With the help of a cookie, the information and offers on our site can be optimized in accordance with the user because cookies allow us, as mentioned above, to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. The user of the website who uses cookies, for example, should not enter access data every time the site is accessed, because it is taken over by the website and the cookie is thus stored in the user's computer system. Another example is a shopping cart cookie in an online store; the store remembers the items that a customer has placed in the virtual shopping cart through a cookie module. During use, we may automatically collect information such as the IP addresses which the site is being accessed from and the browser used, for the purpose of ensuring optimal access to the website and its operation by users/customers. NEWSLETTER Our website offers users the opportunity to subscribe to the company's newsletter. Jadrel regularly informs its customers and business partners about the company's offers, through a newsletter. The company newsletter can only be received by the data subject if (1) the data subject has a valid     e-mail address and (2) if the data subject registers to receive the newsletter. A confirmation e-mail will be sent to the address registered by the data subject for the first time, in order to send the newsletter, for legal reasons, through the double opt-in procedure. This confirmation e-mail is used to prove that the owner of the e-mail address is authorized to receive the newsletter. During the newsletter subscription, we store the IP address of the computer system assigned by the Internet Service Provider (ISP) and used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary to understand the possible inappropriate use of the e-mail address of a targeted person at a later date, and therefore serves the purpose of legal protection. Personal data collected as part of a newsletter subscription will only be used to send the newsletter. In addition, by adding a product to the wishlist section, the user consents to receive transactional messages, including stock status messages or price changes to the products listed in the favorites category.   CONTACT Jadrel website contains information that allows a short electronic contact with our company, as well as direct communication with us, by including a general e-mail address - office@jadrel.ro. If a data subject contacts us by e-mail or through the contact form, the personal data transmitted by him voluntarily are stored automatically. Such personal data, voluntarily transmitted by a data subject to the operator, are stored for the purpose of processing and contacting the data subject. RETENTION TIME Jadrel will process and store the personal data of the data subject only for the period necessary to fulfill its storage purpose, or for the period that is provided by the European legislator or by other applicable laws. If the purpose of the storage is not applicable, or if the storage period provided by the applicable legislation in force expires, the personal data are deleted, in accordance with the legal requirements. THE RIGHTS OF THE DATA SUBJECT The right of access of the data subject – order to exercise the right of access, the data subject may at any time contact Jadrel with a request in this regard to obtain a report of personal data; The right of rectification – each data subject has the right to obtain the rectification of personal data when they are incorrect or have undergone certain changes or need to be completed; The right to deletion – each data subject has the right to request the deletion of personal data as follows:

  • when the data is no longer necessary for the purpose for which they were collected or processed
  • the data subject withdraws his consent on the basis of which the processing takes place
  • the data subject objects to processing, in accordance with Article 21 (1) of the Regulation, and there are no legal grounds for processing, or the data subject objects to processing in accordance with Article 21 (2) of the Regulation;
  • personal data have been illegally processed or a legal provision in force requires their deletion.

The right to data portability – each data subject has the right to request the transfer of personal data to a third party or to the data subject himself. The right to opposition – each data subject has the right to object at any time, for reasons related to his/her particular situation, to the processing of personal data concerning him/her, which is based on points (e) and (f) of Article 6 (1) of the Regulation. This also applies to profile creation. Jadrel will no longer process personal data in the event of opposition, unless we can demonstrate convincing and legitimate grounds for processing that override the interests, rights and freedoms of the data subject, or for establishing, exercising or defending legal rights. If Jadrel processes personal data for direct marketing purposes, where there is prior consent, the data subject will have the right to object at any time to the processing of his personal data for such marketing. If the data subject objects to the processing performed by Jadrel for direct marketing purposes, then Jadrel will no longer process his personal data for these purposes. In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to the processing of his or her personal data by Jadrel for scientific or historical research purposes, or for statistical purposes, in accordance with Article 89 (1) of Regulation, unless the processing is necessary for the performance of a task performed in the public interest. Making individual decisions, including creating profiles – each data subject has the right not to be subjected to a decision based solely on automatic processing, including profiling, which has legal effects on it or similarly affects him or her significantly, as long as the decision is not based on explicit consent of the data subject. Jadrel will implement appropriate support measures to protect the rights and freedoms of the data subject and its legitimate interests, the right to obtain human intervention from Jadrel, to express its views and to challenge the decision. The right to withdraw consent – each data subject has the right to withdraw his/her consent to the processing of personal data at any time. The right to file a complaint to the supervisory authority – if the data subject considers that his/her legitimate rights in relation to the processing of personal data have been violated, the data subject may apply to the National Supervisory Authority For Processing Personal Data, based in G-ral Blvd. Gheorghe Magheru no. 28-30, District 1, postal code 010336, Bucharest, Romania. The right to go to court – if the amicable settlement of a dispute is not possible, the person concerned may apply to the court for settlement. If you wish to exercise your rights or send us a notification/request, please contact us in the contact section indicated on the website. Jadrel will reply to you as soon as possible but not later than 30 days. For any delays, we will notify you and give you the justified reasons for the delay. LEGAL BASIS FOR PROCESSING If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, when the processing operations are necessary for the supply of goods or for any other service, the processing is based on Article 6, paragraph (1), lit. b of the Regulation. The same applies to processing operations that are necessary for the performance of               pre-contractual measures, for example in the case of inquiries into our products or services. Our company is subjected to a legal obligation which requires the processing of personal data, such as the fulfillment of fiscal obligations, the processing being based on Art. 6 (1) lit. c of the Regulation. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor has been injured in our company and the name, age, health insurance data or other vital information should be passed on to a doctor, hospital or other third party. Then, the processing will be based on Art. 6, paragraph (1) lit. d of the Regulation. Finally, processing operations could be based on Article 6, paragraph (1), lit. f of the Regulation. This legal basis is used for processing operations that are not covered by any of the legal reasons mentioned above, if the processing is necessary for the legitimate interests pursued by our company or a third party, unless such interests are removed by the interests or fundamental rights and freedoms of the data subject who require the protection of personal data. Such processing operations are especially permitted because they have been specifically mentioned by the European legislator. We clarify that the provision of personal data is required partialy by law (i.e. tax regulations) or may result from contractual provisions (i.e. information on the contractual partner). Sometimes it may be necessary to conclude a contract in accordance with the personal data provided by the data subject, which must be further processed by us. The data subject is, for example, obliged to provide us with personal data when our company signs a contract with him or her. PAYMENT – BILLING Accepted payment methods on our website - https://www.jadrel.ro/: 1. Cash payment Payment in cash is made in LEI, in full upon delivery, when the value of purchases does not exceed the amount of 4.999 lei. Cash payments have the following limitations, according to the updated Law 70/2015

  • For legal entities, it is limited to 5.000 RON and the difference through a bank
  • For natural persons:
  • if the invoice is 10.001 (i.e. higher than 10,000 RON), it is limited to 5.000 RON cash and the rest through a bank
  • if the invoice is up to 9.999 RON, the full cash amount can be collected

  • Cards in installments (0 % commission): Advantage Card, Bonus Card, AlphaBank, BRD,

Raiffeisen, Star Card Transilvania, ING

  • Bank transfer: The delivery of the products will be made only after the money enters our account. Payment confirmation can take between 24 and 48 hours.

PENALTY TERMS In case the delivery deadlines cannot be met, Jadrel is required to announce the customer the estimated order completion time. The customer will have the right to claim additional damages from Jadrel, in terms permitted by law, in case of total or partial failure by Jadrel to fulfill the contract, in accordance with the established terms. In case the buyer is at fault for delaying the payment of the goods within the term stipulated in the invoice issued by the seller, he is obliged to pay a penalty of 0.5%/day of the amount owed. In case Jadrel receives wrong information related to the billing or the shipping of the goods, a new order fulfillment term will be set, usually within 3 working days. If rebilling is desired, changing your invoice information involves the cancellation of the initial invoice and the issuance of a new invoice. Rebilling can only be done within the same accounting mounth and only for the invoices exceeding the value of 500 lei. Please be aware that re-invoicing is only possible in these cases: legal entity - legal entity or natural person – legal entity, not legal entity – natural person. SHIPPING   Unless otherwise agreed by Jadrel and the customer, Jadrel is discharged from the risks and responsibilities associated with the goods and services the moment they are handed over to the domestic courier company which the company collaborates with. Jadrel will ensure proper packaging of the goods or services and the transmission of their accompanying documents in a sustainable way (by print/mail or on the website in the customer’s account order section). Jadrel will make the delivery of goods and services on Romania’s territory.   ACCEPTANCE AND RIGHT OF CANCELLATION   Acceptance will be made when the goods and services are in accordance with the technical characteristics mentioned in the order. In case the customer discovers that the products delivered or the services provided are not in compliance with the technical specifications, then Jadrel will provide the compliant products and services within a maximum period equal to the term of completion of the order, without charging the customer any costs related to these operations. Jadrel will also comply with the regulations OUG 34/2014 and will apply the return policy. Jadrel has the right, when it considers that the actions of the customer were malicious, to claim damages from him, under the conditions of the legislation. EXCESS GOODS   Any goods delivered in excess of the quantity provided in the order invoice can be rejected by the customer within 7 days of delivery. WARRANTY   In addition to any other guarantees stipulated by the applicable laws and detailed in the warranty certificate issued by Jadrel or by a supplier of Jadrel, Jadrel guarantees the customer against any non-conformity that may affect all or part of the goods and services, except for normal use over time, for a period of 24 months starting from the date of issuance of the sales invoice.   OWNERSHIP TRANSFER   Ownership of the goods and services will be transferred at the moment the payment is made by the customer in the location indicated in the order information (represented by delivery – signing the transport document provided by the courier upon receiving).   LIABILITY   Jadrel cannot be held responsible for the damages of any kind that the customer or any third party may suffer as a result of the Jadrel’s fulfillment of any of its obligations, in accordance with the order, as well as for the damages resulting from the use of goods and services after the delivery is made and, especially, for the loss of products. DERISORY PRICE OR INCORRECT CHARACTERISTICS   Jadrel makes every effort to provide accurate information about the pricse and the features of the products. It is possible for some prices and/or features to be incorrect. In case of registering an order with a derisory price, the seller has the right to cancel the customer’s order. In the case of registering an order for a product with incorrect characteristics, Jadrel will make every effort to deliver to the customer a product with characteristics as close as possible to the ones presented on the website at the moment of placing the order. If the customer does not agree with the seller’s proposals, Jadrel has the right to cancel the customer’s order. VIOLATION – TERMINATION   If Jadrel does not fulfill its obligations, including the ones during the warranty period, the customer will notify Jadrel about this non-fulfillment. An action plan will be validated between the parties within 3 days of notification. The customer can cancel an order via e-mail, before it has been delivered. Otherwise, the order will be subjected to the return of the goods mentioned on Jadrel’s website.   FORCE MAJEURE   Neither party will be held responsible for any breach of its contractual obligations, if such breach is caused by an event of force majeure. The force majeure is an unpredictable event, beyond the parties control, which cannot be avoided. APPLICABLE LAW – JURISDICTION   The present contract is subjected to the Romanian law. Any disputes arising from the interpretation and execution of this contract will be settled amicably and, if no agreement is reached in this way, the competent courts from Jadrel’s premises will pe appealed. DIFFERENT STIPULATIONS   Jadrel Software and IT Services SRL reserves the right to refuse cooperation with customers who exhibit inappropriate behavior and language, in writing or verbally (aggressive, licentious, etc.), who have multiple refused deliveries in their order’s history or abusively use the right of return within 14 days. For placing an order, minors must have the consent of their legal representatives. Jadrel Software and IT Services does not apply the broken down payment of VAT, according to the Registry of persons who apply the broken down payment of VAT.
